Les unités de construction, comme les lacunes, leur potentiel chimique, le nombre quantique cristallographique et plusieurs aspects des propriétés spectroscopiques des électrons 4f dans les cristaux ioniques, sont présentés comme des exemples remarquables d’objets ou de propriétés émergents (ou submergents) rencontrés (...) dans l’état cristallin. In this paper, we try to understand how Bunge’s scientific hylorealism can fit with several crystal chemistry’s objects and their properties. It is found that many of them, lying at the very core of this discipline, bring support to ontologi-cal emergentism. Building units, such as vacancies, their chemical potential, the crystal quantum number and many aspects of the spectroscopic properties of 4f electrons in ionic crystals, are presented as striking examples of emergent (or submergent) objects or properties encountered in the (...) single crystalline state. This paper addresses the relationship between logic and phenomenology at a historical moment that precedes the big divide between analytic philosophy and phenomenology. In analysing alternative derivations of phenomenological logic, the discussion focuses on the case of two notorious neo-Kantian Mexican philosophers from the first half of the XXth century: Adalberto García de Mendoza and Francisco Larroyo. It is argued that both García de Mendoza and Larroyo made an original contribution to the discussion on the relationship between phenomenology and logic. (...) Further, this paper attempts to present a charitable portrait of both García de Mendoza and Larroyo in contrast to underrating approaches to both Mexican philosophers. In so doing, this paper adopts a historical—though not strictly biographical— perspective. While it is true that neither García de Mendoza nor Larroyo could be considered “phenomenologists” or “Husserl scholars” according to contemporary standards it is worth noticing that they engage in the discussion of phenomenological logic. Both authors had the project of developing a grounding logic for science and, as the article argues, both attempts could be even linked. Their project, however, was unfinished. The plan of this paper is as follows. The first section addresses the problem of the relationship between logic and phenomenology. The second one focuses on García de Mendoza’s contributions. The third one elaborates on Larroyo’s Logic of Sciences. And, finally, the fourth section elaborates on these Mexican philosophers’ contributions to education, making as well further observations concerning the similarities and differences between both authors. The renewed interest in concepts and their role in psychological theorizing is partially motivated by Machery’s claim that concepts are so heterogeneous that they have no explanatory role. Against this, pluralism argues that there is multiplicity of different concepts for any given category, while hybridism argues that a concept is constituted by a rich common representation. This article aims to advance the understanding of the hybrid view of concepts. First, we examine the main arguments against hybrid concepts and conclude that, (...) even if not successful, they challenge hybridism to find a robust criterion for concept individuation and to show an explanatory advantage for hybrid concepts. Then we propose such a criterion of individuation, which we will call ‘functional stable coactivation’. Ezra Pound got many things wrong. He was a poor judge of character and a supporter of causes and individuals that have done and continue to do much harm to people around the world. This book addresses the matters (literary and philosophical) that Pound got right, while still pointing out the flaws; it highlights the impact such evidence may yield for the student of art. -/- The result of my research in the pages that follow may be described as a (...) study in aesthetic affinities between Ezra Pound’s thought and the guiding notions found in the Confucian lore. The question it attempts to exemplify is that long-standing one about the nature of knowledge. -/- The analysis that follows seeks to provide a variety of perspectives (both in terms of disciplines and interpretations) about how Pound created with his writings a metaphor of knowledge to understand, assimilate, and put to use his discovery of the East as represented by the Confucian mind. Using the method of Descriptive Experience Sampling, some subjects report experiences of thinking that do not involve words or any other symbols [Hurlburt, R. T., and C. L. Heavey. 2006. Exploring Inner Experience. Amsterdam: John Benjamins; Hurlburt, R. T., and S. A. Akhter. 2008. “Unsymbolized Thinking.” Consciousness and Cognition 17 : 1364–1374]. Even though the possibility of this unsymbolized thinking has consequences for the debate on the phenomenological status of cognitive states, the phenomenon is still insufficiently examined. This paper analyzes (...) the main properties of unsymbolized thinking and advances an explanation of its origin. According to our analysis, unsymbolized thoughts appear as propositional states, that is, they are experienced as compositional conceptual phenomena, with semantic and syntactic features analogous to those of the contents of utterances. The objective of this article is to demonstrate how the historical debate between materialism and idealism, in the field of Philosophy, extends, in new clothes, to the field of Quantum Physics characterized by realism and anti-realism. For this, we opted for a debate, also historical, between the realism of Albert Einstein, for whom reality exists regardless of the existence of the knowing subject, and Niels Bohr, for whom we do not have access to the ultimate reality of the matter, unless (...) conditioning it to the existence of an observer endowed with rationality, position adopted in the Interpretation of Complementarity – posture that was expanded in 1935 when Bohr assumed a “relationalist” conception, according to which the quantum state is defined by the relationship between the quantum object and the entire measuring device. This is an extremely important debate, as it further consolidates the results of nascent Quantum Mechanics, guaranteeing Bohr the leadership of the orthodoxy based on the interpretation of complementarity. Here, when dealing with Quantum Theory, we will not make any distinction between the terms Quantum Physics, Quantum Theory or Quantum Mechanics. The entire discussion will be held under the name “Quantum Theory”. Theory that tries to analyze and describe the behavior of physical systems of reduced dimensions, close to the sizes of molecules, atoms and subatomic particles. We hope that the reader will appreciate the genius of these two titans in this field of Physics when they magnificently formulate the arguments that support the object of their defenses. (shrink)

El contenido de la presente discusión de Análisis Filosófico surge a partir de diversas actividades organizadas por mí en SADAF y en la UBA. En primer lugar, Roy Cook dictó en SADAF el seminario de investigación intensivo On Yablo's Paradox durante la última semana de julio de 2011. En el seminario, el profesor Cook presentó el manuscrito aún sin finalizar de su libro The Yablo Paradox: An Essay on Circularity, Oxford, Oxford UP, (en prensa). Extensas y apasionantes discusiones ocurrieron durante (...) esos encuentros sobre circularidad y construcciones infinitarias. Fue en ese tiempo, donde me surgió la idea de editar una discusión sobre las ideas que Cook defiende en ese trabajo. El proyecto era una extensión natural del trabajo que veníamos realizando con mi grupo de investigación en temas vinculados al concepto de verdad, autorreferencia y paradojas. Luego, durante el segundo cuatrimestre de 2011, dicté el seminario La paradoja de Yablo, en el instituto de filosofía de la UBA. Algunos de los borradores de los artículos que aparecen en el presente volumen tienen su origen en este curso. Finalmente, invité por segunda vez al profesor Cook al Symposium on Yablo's Paradox realizado en SADAF en julio de 2012. En esta oportunidad, se presentaron las versiones finales de los artículos de Lavinia Picollo, Paula Teijeiro, Federico Pailos, Diego Tajer, Lucas Rosenblatt e Ignacio Ojea que se incluyen a continuación. Internal coherence is of great importance for how we think about appreciating objects of aesthetic worth. A disagreement between what we judge to be worthy and what we affectively favor can prevent us from properly grasping its value. However, it is also assumed in the aesthetic domain that our taste changes over time, jeopardising such coherence constraint. These changes can lead to a mismatch between new aesthetic judgments and old aesthetic preferences. This chapter explores a number of issues that emerge (...) from this tension. Using Taylor Swift’s re-recording as a case study, I will explore the relation between fan loyalty and personal authenticity, as well as the role of biographical taste in the reception of these newly recorded albums among Swift’s long-time fanbase. In this note we shall argue that Milne’s new effort does not refute Truthmaker Maximalism. According to Truthmaker Maximalism, every truth has a truthmaker. Milne has attempted to refute it using the following self-referential sentence M: This sentence has no truthmaker. Essential to his refutation is that M is like the Gödel sentence and unlike the Liar, and one way in which Milne supports this assimilation is through the claim that his proof is essentially object-level and not semantic. In Section (...) 2, we shall argue that Milne is still begging the question against Truthmaker Maximalism. In Section 3, we shall argue that even assimilating M to the Liar does not force the truthmaker maximalist to maintain the ‘dull option’ that M does not express a proposition. There are other options open and, though they imply revising the logic in Milne’s reasoning, this is not one of the possible revisions he considers. In Section 4, we shall suggest that Milne’s proof requires an implicit appeal to semantic principles and notions. In Section 5, we shall point out that there are two important dissimilarities between M and the Gödel sentence. Section 6 is a brief summary and conclusion. (shrink)

Both Franz Brentano and Edmund Husserl addressed sound while trying to explain the inner consciousness of time and gave to it the status of a supporting example. Although their inquiries were not aimed at clarifying in detail the nature of the auditory experience or sounds themselves, they made some interesting observations that can contribute to the current philosophical discussion on sounds. On the other hand, in analytic philosophy, while inquiring the nature of sounds, their location, auditory experience or the audible (...) qualities and so on, the representatives of that trend of thought have remained silent about the depiction of sound and the auditory phenomena in the phenomenological tradition. The paper’s intention is to relate both endeavours, yet the perspective carried out is that of analytic philosophy and, thus, I pay special attention to conceptual analysis as a methodological framework. In this sense, I first explain what sound ontology is in the context of analytic philosophy and the views that it encompasses— namely, the Property View (PV), the Wave View (WV) and the Event View (EV)—. Secondly, I address the problems it entails, emphasising that of sound individuation. In a third section, I propose the possibly controversial conjunction of a “Brentano-Husserl Analysis of the Consciousness of Time” (for short “Brentano-Husserl analysis”) and outline the commonalities of both authors, without ignoring its discrepancies. My main focus is Husserl’s 1905 Vorlesungen zur Phänomenologie des Inneren Zeitbewusstseins. While addressing the Brentano-Husserl analysis, I elaborate on the problem of temporal and spatial extension (Raumlichkeit and Zeitlichkeit, respectively) of both consciousness and sound. Such comparison is a key one, since after these two developments, one can notice some theoretical movements concerning the shift of attention from sounds to the unity of consciousness, and how they mirror each other. After examining the controversial claims concerning the temporal and spatial extension of both consciousness and sound, I argue in the concluding paragraphs that while considering the accounts of sound ontology, the Brentano-Husserl analysis would probably endorse a Property View and that this could have interesting consequences for the issue of Sound Individuation. An important objection to signaling approaches to representation is that, if signaling behavior is driven by the maximization of usefulness, then signals will typically carry much more information about agent-dependent usefulness than about objective features of the world. This sort of considerations are sometimes taken to provide support for an anti-realist stance on representation itself. The author examines the game-theoretic version of this skeptical line of argument developed by Donald Hoffman and his colleagues. It is shown that their argument only (...) works under an extremely impoverished picture of the informational connections that hold between agent and world. In particular, it only works for cue-driven agents, in Kim Sterelny’s sense. In cases in which the agents’ understanding of what is useful results from combining pieces of information that reach them in different ways, and that complement one another, maximizing usefulness involves construing first a picture of agent-independent, objective matters of fact. In this paper, I start by describing and examining the main results about the option of formalizing the Yablo Paradox in arithmetic. As it is known, although it is natural to assume that there is a right representation of that paradox in first order arithmetic, there are some technical results that give rise to doubts about this possibility. Then, I present some arguments that have challenged that Yablo’s construction is non-circular. Just like that, Priest (1997) has argued that such formalization (...) shows that Yablo’s Paradox involves implicit circularity. In the same direction, Beall (2001) has introduced epistemic factors in this discussion. Even more, Priest has also argued that the introduction of infinitary reasoning would be of little help. Finally, one could reject definitions of circularity in term of fixed-point adopting non-well-founded set theory. Then, one could hold that the Yablo paradox and the Liar paradox share the same non-well-founded structure. So, if the latter is circular, the first is too. In all such cases, I survey Cook’s approach (2006, forthcoming) on those arguments for the charge of circularity. In the end, I present my position and summarize the discussion involved in this volume. En este artículo, describo y examino los principales resultados vinculados a la formalización de la paradoja de Yablo en la aritmética. Aunque es natural suponer que hay una representación correcta de la paradoja en la aritmética de primer orden, hay algunos resultados técnicos que hacen surgir dudas acerca de esta posibilidad. Más aún, presento algunos argumentos que han cuestionado que la construcción de Yablo no sea circular. Así, Priest (1997) ha argumentado que la formalización de la paradoja de Yablo en la aritmética de primer orden muestra que la misma involucra implícitamente circularidad. En la misma dirección, Beall (2001) ha introducido factores epistémicos en esta discusión. Más aún, Priest ha también argumentado que la introducción de razonamiento infinitario como complemento de la formalización en la aritmética sería de poca ayuda. Finalmente, se podría rechazar todo intento de dar definiciones de circularidad en términos de puntos fijos adoptando teoría de conjuntos infundados. Entonces, se podría sostener que la paradoja de Yablo y la del mentiroso comparten la misma estructura infundada. Por eso, si la última es circular, también lo es la primera. En todos los casos, presento el enfoque de Roy Cook (2006, en prensa) sobre estos argumentos que atribuyen circularidad a la construcción de Yablo. Transhumanism proposes human enhancement while regarding the human body as unfit for the future. This fulfills age-old aspirations for a perfect and durable body. We use “alienation” as a concept to analyze this mismatch between human aspirations and our current condition. For Hannah Arendt alienation may be accounted for in terms of earth- and world-alienation, as well as alienation from human nature, and especially from the given (“resentment of the given”). In transhumanism, the biological body is an impediment to human (...) accomplishment. At most, this movement accepts “clean” bodies, not bodies with excretions. We argue that real human bodies are valued in the event of giving birth, so a modified concept that Arendt proposed, natality, seems a suitable way to explore the dialectic alienation-reconciliation involving the body (Arendt’s “A child has been born unto us”), when re-read by some feminist scholars. This paper addresses the problem of sound individuation (SI) and its connection to sound ontology (SO). It is argued that the problems of SI, such as aspatiality, extreme individuation, indexical perplexity and duration puzzles are due to SO’s uncertainties. Besides, I describe the views in SO, including the wave view (WV), the property view (PV), and the event view (EV), as Casey O’Callaghan defends it. According to O’Callaghan, EV offers clear standards to individuate sounds. However, this claim is countered by (...) the consideration that any view could also defend the standards in SO, and thus, EV does not solve any of the problems mentioned above. As a way of showing the difficulties inherited by sound’s inner ontology, the problem of its linguistic representation is also addressed. The problem of SI can be developed within the frame of the philosophy of language and, specifically, regarding the discussion about mass vs count-­sortal terms. Is the term sound a mass or a count­-sortal? It is shown that, for reasons pertaining SO, the decision regarding the case of sound as a mass or count-­sortal term remains open. SI is, thus, covered from the SO to the philosophy of language. (shrink)

There is a dimension of rationality, known as structural rationality, according to which a paradigmatic example of what it means to be rational is not to be akratic. Although some philosophers claim that aesthetics falls within the scope of rationality, a non-akrasia constraint prohibiting certain combinations of attitudes is yet to be developed in this domain. This essay is concerned with the question of whether such a requirement is plausible and, if so, whether it is an actual requirement of aesthetic (...) rationality. Ultimately, this paper defends the view that aesthetics is no different from other domains in that it requires coherence between a subject’s mental states (in the aesthetic case, between what is judged and what is aesthetically liked). In De partibus animalium A1, Aristotle presents —in a darker than usual way— decisive details of the methodology he devised for his science of nature. His indications seem to point the path along which Aristotelian biology should travel. However, numerous textual and systematic difficulties have given rise to a number of conflicting interpretations, in the context of a vigorous stream of philosophical research and debate since the last third of the last century. In this stream of studies, Michael of Ephesus’s (...) commentary on PA and his views on the subject remain relatively ignored. A complex multiplicity of factors seems to support the lack of sufficient consensus among leading contemporary specialists to explicitly consider those contributions. The purpose of this paper is to examine several of these factors and, based on the evidence provided by little explored aspects of Michael’s texts, to offer arguments in favor of that consensus against a number of alternatives. I shall argue that the contributions of this late commentator deserve to be considered —mutatis mutandis— as seriously as it is done with the main ancient Greek commentaries; in particular, in the philosophical studies of those who are currently interested in that methodology or are engaged in Aristotelian biology. In the first part of the paper, I present a framework for the description and evaluation of teleosemantic theories of intentionality, and use it to argue that several different objections to these theories (the various indeterminacy and adequacy problems) are, in a certain precise sense, manifestations of the same underlying issue. I then use the framework to show that Millikan's biosemantics, her own recent declarations to the contrary notwithtanding, presents indeterminacy. In the second part, I develop a novel teleosemantic proposal (...) which makes progress in the treatment of this family of problems. I describe a procedure to derive a (unique) homeostatic property cluster [HPC] from facts having to do with the properties that a certain indicator relied on, in the events leading to its fixation in a certain population. This HPC is the one that should figure in the content attribution to the indicator in question. (shrink)

Abstract: Introspection reveals that one is frequently conscious of some form of inner speech, which may appear either in a condensed or expanded form. It has been claimed that this speech reflects the way in which language is involved in conscious thought, fulfilling a number of cognitive functions. We criticize three theories that address this issue: Bermúdez’s view of language as a generator of second-order thoughts, Prinz’s development of Jackendoff’s intermediate-level theory of consciousness, and Carruthers’s theory of inner speech as (...) a rehearsal of action-schemata. We contend they have problems to account for those cases in which inner speech is fragmentary, and for the difference with those instances in which it appears as more sentence-like. In addition, we present verbal overshadowing as a phenomenon that neither of them can easily explain. Finally, we propose an account in which inner speech is fundamentally silent outer speech and argue that it is more explanatory than the alternatives. (shrink)

Transhumanists, like other elites in modernity, place great value on human creativity, and advances in human enhancement and AI form the basis of their propos- als for boosting it. However, there are problems with this perspective, due to the unique ways in which humans have evolved, procreated and socialized. I first describe how creativity is related to past evolution and developmental aspects in children, stressing pretend play and the ambivalent character of creativity. Then, I outline proposals for enhancing creativity, be (...) it in embodied humans on the way to a superior species, in AI- related beings (virtual reality, robotics), or even in any degree of mixture in human- machine interaction. In the final section, I describe intrinsic limits to these proposals, such as the absence of a good understanding of human psychology by the proponents of enhancement; the lack of interest in the subjective side of creativity (for one’s own sake); delayed maturation and the ambivalence of pretend play in childhood; and the contrariness typical of new human generations. As for the enhancement of creativity, it is argued that creativity in its social context may be the victim of its own past success. On the other hand, an asymmetry between virtual beings and children is described— the latter can behave in a nasty way, it is part of their growth and creativity, whereas the former are not supposed to cause any harm to human beings. In sum, despite impressive progress in several scientific and technological interventions in creativity, philosophical questions emerge that place many constraints on transhumanist dreams of endless creativity. By the beginning of the 19th century Hegel's dialectic turned contradiction (conceived as unity of a concept with its determined negation) into distinguished inference. In the course of 20th century a family of systems known as "paraconsistent" formalized dialectical logic according to the contemporary paradigm of inference, oriented to truth-preserving, and not powered anymore solely by contradiction. In this way, nevertheless, Hegel's idea of logic as unfolding of concepts ordered by degree of "determination" reached at every step of the process, (...) was put aside. We attempt to recover the importance of that idea for the hegelian concept of "logical necessity", pointing out in addition that it may well play the role of an order relation for dialectical inference. Some recent literature [Hicks, M. T. and van Elswyk. P., (2015) pp. 433-443, 2015; Bhogal, H. (2017), pp. 447-460] has argued that the non-Humean conceptions of laws of nature have a same weakness as the Humean conceptions of laws of nature. That is, both conceptions face an explanatory circularity problem. The argument is as follows: the Humean and the non-Humean conceptions of laws of nature agree that the law statements are universal generalisations; thus, both conceptions are vulnerable to an explanatory (...) circularity problem between the laws of nature and their instances. In this paper, I argue that Armstrong’s necessitarian view of laws of nature is invulnerable to this explanatory circularity problem. (shrink)

There has been much discussion of so-called teleosemantic approaches to the naturalization of content. Such discussion, though, has been largely confined to simple, innate mental states with contents such as ?There is a fly here.? Even assuming we can solve the issues that crop up at this stage, an account of the content of human mental states will not get too far without an account of productivity: the ability to entertain indefinitely many thoughts. The best-known teleosemantic theory, Millikan's biosemantics, offers (...) an account of productivity in thought. This paper raises a basic worry about this account: that the use of mapping functions in the theory is unacceptable from a naturalistic point of view. (shrink)

Las «metáforas», «analogías» o «alegorías» tienen un lugar bien ganado en la tradición filosófica. Han sido atacadas por dar lugar a una interpretación poco rigurosa de las nociones que describen, pues permite asociarles propiedades que originalmente no se había pensado (ni resulta deseable) que formen parte de su concepto. Sin embargo, a pesar del reclamo en favor de procedimientos estrictos de definición, el uso de una imagen apropiada suele ser el mejor modo de explicar esas cuestiones que cada siglo escapan (...) a la disección que el filo de las mejores definiciones pretendía darle. Tal es el caso de las ilustraciones usadas por Charles S. Peirce en sus artículos "Algunas consecuencias de cuatro incapacidades" y "Cómo esclarecer nuestras ideas" para dar cuenta del pensamiento. Primero veremos el papel que juegan estas imágenes en la argumentación conque Peirce establece dos principios importantes de su filosofía: el de que toda cognición se encuentra determinada por otras cogniciones previas, y el de que no tenemos ningún poder de introspección. Luego hallaremos que dos de las imágenes presentan cierta incompatibilidad en un aspecto especialmente relevante desde el punto de vista de lo que tratan de ilustrar. Para finalizar, consideraremos una explicación que sea consistente con los textos y que permita resolver la discrepancia, brindando una mejor comprensión conjunta de ambas ilustraciones . (shrink)

Our aim in this article, after providing the general framework of the reception of William James in Spain, is to trace the reception of The Varieties of Religious Experience through Unamuno’s reading of this book.

In consciousness studies there is a growing tendency to consider experience as (i) fundamentally affective and (ii) deeply interlinked with interoceptive and homeostatic bodily processes. However, this view still needs further development to be part of any rigorous theory of consciousness. To advance in this direction, we ask: (1) is there any affective type that is always present in consciousness?, (2) is it related to interoception and homeostasis?, and (3) what are its properties? Here we analyse and compare Jim Russell's (...) core affect and Thomas Fuchs' concept of vitality, and propose a more encompassing notion that subsumes both: continuous organismic sentience. It provides affirmative answers to questions 1 and 2, and, regarding question 3, a preliminary list of thirteen properties divided into ontological, phenomenological, and functional categories. This is the first of a series of studies that will systematically address different notions of a fundamental, homeostatically-rooted affective type, to achieve a rigorous, unified concept for consciousness science. The translational research community, in general, and the Clinical and Translational Science Awards (CTSA) community, in particular, share the vision of repurposing EHRs for research that will improve the quality of clinical practice. Many members of these communities are also aware that electronic health records (EHRs) suffer limitations of data becoming poorly structured, biased, and unusable out of original context. This creates obstacles to the continuity of care, utility, quality improvement, and translational research. Analogous limitations to sharing objective data in (...) other areas of the natural sciences have been successfully overcome by developing and using common ontologies. This White Paper presents the authors’ rationale for the use of ontologies with computable semantics for the improvement of clinical data quality and EHR usability formulated for researchers with a stake in clinical and translational science and who are advocates for the use of information technology in medicine but at the same time are concerned by current major shortfalls. This White Paper outlines pitfalls, opportunities, and solutions and recommends increased investment in research and development of ontologies with computable semantics for a new generation of EHRs. According to many philosophers, rationality is, at least in part, a matter of one’s attitudes cohering with one another. Theorists who endorse this idea have devoted much attention to formulating various coherence requirements. Surprisingly, they have said very little about what it takes for a set of attitudes to be coherent in general. We articulate and defend a general account on which a set of attitudes is coherent just in case and because it is logically possible for the attitudes to (...) be jointly satisfied in the sense of jointly fitting the world. In addition, we show how the account can help adjudicate debates about how to formulate various rational requirements. (shrink)

Legal theorists seek to persuade other jurists of certain theories: Textualism or purposivism; formalism or realism; natural law theory or positivism; prison reform or abolition; universal or particular human rights? Despite voluminous literature about these debates, tremendous uncertainty remains about which views experts endorse. This Article presents the first-ever empirical study of American law professors about legal theory questions. A novel dataset of over six hundred law professors reveals expert consensus and dissensus about dozens of longstanding legal theory debates. -/- (...) Law professors also debate questions about the nature of the legal academy. Descriptively, which subjects (e.g. constitutional law) and methods (e.g. law & economics) are most central within the legal academy today? And prescriptively, should today’s legal academy prioritize additional areas (e.g. legislation) or methods (e.g. critical race theory)? There is great interest in these questions but no empirical dataset of experts’ views; this results in uncertainty about which views experts endorse. This Article’s empirical study also clarifies these questions, documenting law professors’ evaluation of over one-hundred areas of law. -/- The legal theory and legal academy findings support implications for legal scholarship, education, and practice. Clearly, debates about law and the legal academy’s evolution should not be settled by a survey. Nevertheless, insofar as law professors are experts about these issues, it is instructive to discover and carefully examine what views those experts hold, so as to help determine which views are most likely to be true and how the legal academy ought to develop. I explore some of the connections between Grahek's model of asymbolic pain, as developed in Feeling Pain and Being in Pain, and the contemporary intentionalist discussion over evaluativist and imperativist models of pain. I will sketch a Grahekian version of imperativism that is both true to his main insights and better at confronting some of the challenges that his theory has faced since its publication.

In the predominant pedagogical frameworks of our days, rationalist, voluntarist or sentimentalist reductionisms are seen, from which it is about educating people regardless of their Origin and the singular and unrepeatable originality with which they have been given to existence. Faced with this anthropocentric confinement, Sensitive Education arises so that every person, regardless of their culture and creed, remains sensitive to their Origin and captures their own originality, which in the end is what they must accept and try to manifest (...) with education. When educational systems are not sensitive to the original, they develop falsehood. With the aim of consolidating the validity of the pedagogical-anthropological foundation of Sensitive Education, this study seeks to show how Edith Stein’s argument explains Sensitive Education, although Stein, after her conversion, uses explicitly Christian terminology. Stein’s direct terms serve to describe Education Sensitive to the Holy Spirit, but for those who do not start from a Christian worldview, Education Sensitive to Origin can be a more non-denominational way of approaching the Original. To achieve this objective, an analytical-synthetic methodology has been followed in which essential features of Sensitive Education are proposed and in a hermeneutic manner, arguments are extracted from the writings of Edith Stein that offer support for these essential features. In conclusion, it is sufficiently shown that Edith Stein’s thought provides a pedagogical foundation to Sensitive Education. (shrink)

Introduction: Traditionally, empathy has been studied from two main perspectives: the theory-theory approach and the simulation theory approach. These theories claim that social emotions are fundamentally constituted by mind states in the brain. In contrast, classical phenomenology and recent research based on enactive theories consider empathy as the basic process of contacting others’ emotional experiences through direct bodily perception and sensation. Objective: This study aims to enrich knowledge of the empathic experience of pain by using an experimental phenomenological method. Method: (...) Implementing an experimental paradigm used in affective neuroscience, we exposed 28 healthy adults to a video of sportspersons suffering physical accidents while practicing extreme sports. Immediately after watching the video, each participant underwent a phenomenological interview to gather data on embodied, multi-layered dimensions (bodily sensations, emotions, and motivations) and temporal aspects of empathic experience. We also performed quantitative analyses of the phenomenological categories. Results: Experiential access to the other person’s painful experience involves four main-themes. Bodily resonance: participants felt a multiplicity of bodily, affective, and kinesthetic sensations. Attentional focus: some participants centered their attention more on their own personal discomfort and sensations of rejection, while others on the pain and suffering experienced by the sportspersons. Kinesthetic motivation: some participants experienced the feeling in their bodies to avoid or escape from watching the video, while others experienced the need to help the sportspersons avoid suffering any injury while practicing extreme sports. Temporality of experience: participants witnessed temporal fluctuations in their experiences, bringing intensity changes in their bodily resonance, attentional focus, and kinesthetic motivation. Finally, two experiential structures were found: one structure is self-centered empathic experience, characterized by bodily resonance, attentional focus centered on the participant’s own experience of seeing the sportsperson suffering, and self-protective kinesthetic motivation; the other structure is other-centered empathic experience, characterized by bodily resonance, attentional focus centered on the sportsperson, and prosocial kinesthetic motivation to help them. Discussion: We show how phenomenological data may contribute to comprehending empathy for pain in social neuroscience. In addition, we address the phenomenological aspect of the enactive approach to the three dimensions of embodiment of human consciousness, especially the intersubjective dimension. Also, based on our results, we suggest an extension of the enactive theory for non-interactive social experience. (shrink)

The choice is often stark and carries with it (...) the imposition of restrictions on what will be possible in terms of existing customs, culture, and direct involvement with friends and family, and signifies a leap of faith into what appears to be a better, more prosperous, happier future. -/- At times, such choice is unavoidable, others it turns out to be a gamble of sorts, but, no matter what the cause, reason, or desire underlying an act of migration away from what the emigrant has known, it never turns out to be what was expected and no amount of preparation allows the emigrant to anticipate what will in fact occur. Some mental states have valence—they are pleasant or unpleasant. According to imperativism, valence depends on imperative content, while evaluativism tells us that it depends on evaluative content. We argue that if one considers valence’s informational profile, it becomes evident that imperativism is superior to evaluativism. More precisely, we show that if one applies the best available metasemantics to the role played by (un)pleasant mental states in our cognitive economy, then these states turn out to have imperative rather than evaluative content, (...) since: (i) they are much more informative about behaviour than they are about the world; and (ii) they occupy a stage in the information-processing chain that is closer to behaviour production than it is to the uptake of sensory information. Paraconsistent logics are logical systems that reject the classical principle, usually dubbed Explosion, that a contradiction implies everything. However, the received view about paraconsistency focuses only the inferential version of Explosion, which is concerned with formulae, thereby overlooking other possible accounts. In this paper, we propose to focus, additionally, on a meta-inferential version of Explosion, i.e. which is concerned with inferences or sequents. In doing so, we will offer a new characterization of paraconsistency by means of which a logic is (...) paraconsistent if it invalidates either the inferential or the meta-inferential notion of Explosion. We show the non-triviality of this criterion by discussing a number of logics. On the one hand, logics which validate and invalidate both versions of Explosion, such as classical logic and Asenjo–Priest’s 3-valued logic LP. On the other hand, logics which validate one version of Explosion but not the other, such as the substructural logics TS and ST, introduced by Malinowski and Cobreros, Egré, Ripley and van Rooij, which are obtained via Malinowski’s and Frankowski’s q- and p-matrices, respectively. Mais il souligne également qu’elle ne se réduit pas à la science, car elle intègre d’autres éléments. Il est particulièrement préoccupé par l’étude du lien entre technologie et science. Sur la base de leur caractérisation, ces autres éléments sont explorés – l’approche inverse. Cette perspective permet une caractérisation épistémologique plus approfondie des technologies.

Philosopher Fiona Wollard recently advocated interpreting the achievements of women while giving birth. People readily recognize men-related achievements, like running a marathon, but not achievements related to giving birth. We expand on Woollard's notion of reproductive achievements, comparing them with ideas of human enhancement, which aims at humans becoming "stronger and faster". Criticisms to evolutionary psychology challenge its defense of a notion of a fixed human nature, and its disregard for the experience of birth. Some female scholars link human evolution (...) to the presence of premature infants requiring attention from mothers and alloparents. They explain why this gave an advantage to the human species, enhancing cooperation and other desirable traits. Other scholars develop philosophies of birth, mostly based on Arendt's conception of natality, questioning a human nature not sensitive to gender, excluding birth and childhood. Then we move to transhumanism, proponent of human enhancement. Transhumanism questions our biological inheritance for being flawed and outdated, including giving birth, restricting this to a source of great suffering. This assessment of the given does not consider its ambiguous, dialectical character. Because of that, tinkering with nature both accomplishes and frustrates the goals of human enhancement. (shrink)

I assess Tamar Gendler's (2007) account of self-deception according to which its characteristic state is not belief, but imaginative pretense. After giving an overview of the literature and presenting the conceptual puzzles engendered by the notion of self-deception, I introduce Gendler's account, which emerges as a rival to practically all extant accounts of self-deception. I object to it by first arguing that her argument for abandoning belief as the characteristic state of self-deception conflates the state of belief and the process (...) of belief-formation when interpreting David Velleman's (2000) thesis that belief is an essentially truth-directed attitude. I then call attention to the fact that Velleman's argument for the identity of motivational role between belief and imagining, on which Gendler's argument for self-deception as pretense depends, conflates two senses of 'motivational role'-a stronger but implausible sense and a weaker but explanatorily irrelevant sense. Finally, I introduce Neil Van Leeuwen's (2009) argument to the effect that belief is the practical ground of all non-belief cognitive attitudes in circumstances wherein the latter prompt action. I apply this framework to Gendler's account to ultimately show that imaginative pretense fails to explain the existence of voluntary actions which result from self-deception. (shrink)

Gottfried Leibniz embarked on a research program to prove all the Aristotelic categorical syllogisms by diagrammatic and algebraic methods. He succeeded in proving them by means of Euler diagrams, but didn’t produce a manuscript with their algebraic proofs. We demonstrate how key excerpts scattered across various Leibniz’s drafts on logic contained sufficient ingredients to prove them by an algebraic method –which we call the Leibniz-Cayley (LC) system– without having to make use of the more expressive and complex machinery of first-order (...) quantificational logic. In addition, we prove the classic categorical syllogisms again by a relational method –which we call the McColl-Ladd (ML) system– employing categorical relations studied by Hugh McColl and Christine Ladd. Finally, we show the connection of ML and LC with Boolean algebra, proving that ML is a consequence of LC, and that LC is a consequence of the Boolean lattice axioms, thus establishing Leibniz’s historical priority over George Boole in characterizing and applying (a sufficient fragment of) Boolean algebra to effectively tackle categorical syllogistic. This chapter connects the phenomenon of double bookkeeping to two critical debates in the philosophy of delusion: one from the analytic tradition and one from the phenomenological tradition. First, I will show how the failure of action guidance on the part of some delusions suggests an argument to the standard view that delusions are beliefs (doxasticism about delusion) and how its proponents have countered it by ascribing behavioral inertia to avolition, emotional disturbances, or a failure of the surrounding environment in (...) supporting the agent’s motivation to act. Second, I will show how the mismatch between the experience of double bookkeeping and that of having the usual propositional attitudes of folk psychology suggests another, more recalcitrant argument not only against doxasticism but against the very attempt to fit delusion into folk psychology. Third, I will show how phenomenologically inspired theories of delusion, such as the multiple realities hypothesis, bypass the debates above and focus on describing and understanding the disturbances in the structure of experience undergone by patients. I conclude that the philosophical discussions ensuing from an appreciation of double bookkeeping show some of the limitations of the analytic philosophical approach to delusion. (shrink)

“Historicity” describes the human condition during one’s life course, marked by contingency and freedom, temporality and finitude. The concept also occurs in evolutionary biology, social sciences and psychology, highlighting history and context. Hannah Arendt situates the capacity for new beginnings at the essence of human beings (natality), allowing for new generations. Transhumanist narratives are shown as foreign to the concept of historicity due to a view of human nature, the load of accumulated past, and directed evolution. Finally, the “back to (...) dust” motif is related to finitude, suggesting that new technologies may move us away from humanness. (shrink)

Two of the most important ideas in the philosophy of law are the “Coase Theorem” and the “Prisoner’s Dilemma.” In this paper, the authors explore the relation between these two influential models through a creative thought-experiment. Specifically, the paper presents a pure Coasean version of the Prisoner’s Dilemma, one in which property rights are well-defined and transactions costs are zero (i.e. the prisoners are allowed to openly communicate and bargain with each other), in order to test the truth value of (...) the Coase Theorem. In addition, the paper explores what effect (a) uncertainty, (b) exponential discounting, (c) and elasticity have on the behavior of the prisoners in the Coasean version of the dilemma. Lastly, the paper considers the role of the prosecutor (and third-parties generally) in the Prisoner’s Dilemma and closes with some parting thoughts about the complexity of the dilemma. The authors then conclude by identifying the conditions under which the Prisoner’s Dilemma refutes the Coase Theorem. (shrink)

This article explores the development of the concept of Phenomenological Psychology in the work of the philosopher Edmund Husserl and, more specifically, in the work "Phenomenological Psychology" that corresponds to vol. IX of the complete works of the philosopher, denominated Husserliana. We present the husserlian through the formation of the concept of Phenomenological Psychology and how its understanding makes possible answers to questions about psychology scientificity, which has been present since its foundation as a modern science, at the end of (...) the XIX century. We conclude that it is necessary to construct an intermediate field between Phenomenology and scientific studies in Psychology, through the rediscovery of Husserl's theory over the possibility of a Scientific Psychology of eidetic-transcendental bases and the usage of the phenomenological method, as well as the intersubjective character of human psyque as the basis of this possibility. This article aims to theoretically analyse so-called character friendship from the perspective of emotions. From this angle, our research enables us to distinguish different types of emotions, and we propose a conceptual model of the hierarchy of the emotions of character friendship and their influence on social behaviour. With this model in hand, the article discusses whether other-oriented emotions fully explain the emotional underpinnings of character friendship. We find other-oriented emotions to be ambiguous because they may or may not be (...) selfless. Thus we question whether these emotions can adequately explain the bonding content of character friendship. We conclude that there is a higher affective tier related to moral emotions and moral behaviour, which we have labelled the ‘bonding feeling’. This feeling is described with reference to its historical precedents (Rof Carballo’s ‘affective warp’), thus explaining its particularity. (shrink)

Subjective rights enjoy limited import in Kelsenian theory for whereas the concept of duty underlies every legal norm, that of rights is merely possible and only emerges when the imposition of the sanction attached to the breach of the duty is made dependent upon a subject's will to bring legal action. The presence of secondary norms establishing certain duties of medical professionals on informed consent displays the existence of correlative reflex rights of patients. Yet, together with secondary norms, Western legal (...) systems typically institute norms of competence enabling patients to take legal action when those duties correlative to their reflex right to informed consent have been infringed. Thus, informed consent constitutes a set of subjective legal positions of patients and medical professionals. Despite its excessive formalism and questionable neutrality, the Kelsenian approach permits to define and clearly distinguish patients' genuine rights from mere aspirations devoid of legal basis.
